This is a courtesy translation. The binding version of this policy is the Hebrew one, available at תנאי שימוש ופרטיות. In the event of any discrepancy, the Hebrew version prevails.
Plannter Ltd. (the “Company”) is the developer and operator of Plannter, including the website and the other actions that can be carried out through the licence it provides (the “Site” and the “Licence”, respectively).
Set out below are the procedures under which the Company operates in collecting and using details about you, including information about your location while using the Licence (the “Privacy Policy”). The purpose of this Privacy Policy is to explain the Company’s practices regarding the privacy of users of the Site, and how the Company uses information provided to it by users or collected by it during use of the Site.
The Company attaches great importance to protecting your privacy and makes considerable efforts to properly safeguard the information provided to it. The Company takes measures to maintain information security and your privacy. This Privacy Policy may change from time to time. Wherever the Company materially changes this policy in a way that affects how it uses information and details you have provided, it will give notice by posting a suitable notice on the Site or by sending an email.
General
Information about you is collected when you use the Site. Some of it identifies you personally — this is information you knowingly provide, for example when registering for a licence. Some of it does not identify you personally and is not stored together with your details — this is statistical and aggregate information, such as the pages you viewed, the offers and actions that interested you, the IP address you connected from, and so on.
In order to use some of the actions available through the Licence conveniently and efficiently, you may be required to provide the Company with a number of details about yourself. These include, among others, your full name, your email address and ID number (the “Personal Information”). You will also be required to provide the Company with information about the business, including its name, type, address and so on. We clarify that you are not legally obliged to provide this Personal Information, and that providing it is done of your own free will.
This Privacy Policy also applies to identifying Personal Information provided by you as part of the registration process for a licence, Personal Information transferred by you while using the Licence — both about you and about third parties — and information collected about you while you browse the Site or carry out actions through the Licence.
If you provide the Company with personal information about a third party, you declare and undertake that: (1) you have obtained that third party’s express consent to provide these details to the Company; (2) that person has given express consent for the Company to collect, process, use and store such information as described in this Privacy Policy and in any agreement concluded between you and the Company.
As stated, providing Personal Information is voluntary and is not a legal obligation. However, the information provided to the Company, including the Personal Information, is necessary in order to create your account and grant the Licence. Even if you have expressly agreed to receive marketing material or other operational information from the Company, you may stop receiving it at any stage by emailing support@plannter.com, or by clicking the “Unsubscribe” button that appears in every Company message containing marketing material.
The Company automatically records on its servers the information received from your browser, mobile phone or any other device, including your IP address and all the pages you visited. By agreeing to these terms of use you consent to such recording. See below regarding the use of cookies.
Use of information
The Company uses the information collected about you (the “Information”) for the purposes below, and by registering for a licence (including registering on the Site) and by using it you agree and confirm that the Company may use the Information as described:
- To display data to you, including access to or usability of the Licence.
- To monitor your use of the Licence.
- To improve the usability of the Licence the Company provides.
- To identify and prevent improper use.
- To enforce the Company’s terms of use.
- To send email to your customers, as part of the actions and at your request.
- For statistical analysis of the Information, for the Company’s purposes.
- For use of the payment plug-in, on a third party’s payment page.
- Mailing and customer communication.
If you do not want the Company to use the information collected about you in this way, you are asked not to use the Licence (including registering on the Site).
Marketing communications
Subject to your express consent, the Company may use the Information for marketing purposes: to send marketing or promotional material to you and/or to the business, including by email, SMS or any other means of communication, based among other things on your location and on segmentation and preferences captured through your use.
The legal basis for processing your Personal Information for the purpose of sending marketing or promotional material is your express consent. You can ask the Company, or any such third party, to stop sending you marketing material at any time by clicking the “Unsubscribe” button on any marketing material sent to you, or by emailing support@plannter.com.
Governing law and jurisdiction
Sole and exclusive jurisdiction over all matters arising from or connected to this Privacy Policy lies solely with the competent court seated in Tel Aviv, Israel. The law applying to this Privacy Policy is Israeli law.
Database
The data you provided, and the data collected about you as described in this Privacy Policy, are held in the Company’s database, registration number 700061895 (the “Database”), under its responsibility, pursuant to the Protection of Privacy Law, 5741-1981.
Every person is entitled to review information about themselves held in a database. A person who has reviewed information about themselves and found it to be incorrect, incomplete, unclear or out of date may apply to the owner of the database asking for it to be corrected or deleted. Such an application should be sent to support@plannter.com.
In addition, if information in the Company’s databases is used for personal approaches to you, you are entitled under the Protection of Privacy Law to demand in writing that information relating to you be deleted from the database, unless the Company is required to retain it by law.
Information security
The Company implements up-to-date systems and procedures for information security on its sites and servers. While these systems and procedures reduce the risk of unauthorised intrusion, they do not provide absolute security. The Company therefore does not undertake that the platform will be entirely immune from unauthorised access to the information stored on it.
To prevent unauthorised access to the Company’s information and data, and in order to protect the information and ensure authorised use of it, the Company implements reasonable and appropriate physical, electronic and administrative procedures, and the Company holds ISO 27001 and ISO 27701 certification. The Company also restricts access to personal and confidential information so that such access is granted only to employees who need it to operate the Site and the actions available through the Licence.
Your information security matters to the Company. When you enter personal or sensitive information on the Site, the Company encrypts it using secure encryption technology (SSL).
You also have a meaningful part in information security — do not disclose or share with any third party the password you use to access the Site, and change it frequently. Each time you finish using the Site we recommend logging out, so that no unauthorised party can use the Site in your name.
Retention and international transfer
The Company will retain information about you as needed in order to provide you with the Licence and the actions available through it, to allow you to access information about yourself even after the Licence ends, to comply with applicable law, to resolve disputes and to enforce the agreements between you and the Company.
The information the Company collects is held in the Database. We store information at various sites and on servers in Europe, including sites based on cloud technology.
International transfer of information – the Company is a global company with customers around the world. The platform and the Site are operated using servers located in Israel and in other countries. By receiving the Licence you give irrevocable and unconditional consent for the Company to store, use, process and transfer this information in accordance with this Privacy Policy in various places around the world, including countries outside Israel where different rules and regulations on privacy protection may apply. The Company accepts responsibility for protecting your Personal Information in accordance with the relevant privacy laws, including the European General Data Protection Regulation (GDPR) 2016/679 and this Privacy Policy.
Disclosure to third parties
The Company may disclose information about you, in whole or in part, including data about your location while using the platform, to any third party, subject to the following conditions:
- As part of the use of the platform that Plannter provides, to your customers only.
- Where disclosure of the information or part of it to certain parties is necessary for information security purposes and in order to carry out actions on the platform. Unless stated otherwise, those parties have no right to use this information beyond the purpose for which the Company provides it.
- The Company will disclose the information as necessary or as required by law or in legal proceedings.
- Where the Company finds that your actions on the platform breach the terms of use, or are carried out for the purpose of fraud of any kind.
- Transfer of information for purposes required by law, and to related clearing parties acting for the Company.
- Transfer and receipt of information from the WhatsApp application in connection with use of that service. Use of WhatsApp is subject to WhatsApp’s own terms of use and privacy policy.
Links to third-party websites may appear on the Site and within the platform. The Company is not responsible for the privacy policy on those sites, and recommends that you check that policy yourself in every case and on every site.
Cookies
A “cookie” is a small text file transferred to your device by a web server. This file is not a computer program and has no ability to read the information held on it or to perform any activity on it. The purpose of using a cookie is so that the Company’s servers can identify you quickly and efficiently when you return to the platform and when you visit other sites.
By agreeing to these terms of use you allow the Company to place a cookie on your device, to use the information stored in the cookie, and to identify you by it.
Through cookies, information about the Company or about third parties may be published on various sites you browse (“third-party providers”). While you use those sites information about you may be collected, and the Company may use it to tailor the advertising content shown to you to subjects that interest you, without identifying you specifically. The Company is not responsible for the operation of third-party providers’ sites or for the content offered on them.
If you prefer to block cookies while browsing a website, you can change your browser’s settings so that it asks for your approval each time individually, or alternatively refuse them altogether. Note that disabling cookies may impair your use of the platform.
